TERMS OF SERVICE — HOMELAND HARVEST

OVERVIEW

Welcome to Homeland Harvest! The terms "we," "us," and "our" refer to Homeland Harvest. Homeland Harvest operates this website and online store, including all related tools, features, products, services, and information (collectively, the "Services") to offer customers a curated clean living shopping experience. Homeland Harvest is powered by Shopify, enabling us to deliver these Services efficiently.

These Terms of Service ("Terms") govern your access to and use of our Services and incorporate by reference our Privacy Policy and Return Policy. By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use our Services.

SECTION 1 - ACCESS AND ACCOUNT

By using our Services, you confirm that you are at least the age of majority in your jurisdiction and legally permitted to enter into this agreement. You may be required to create an account and provide personal information. You are responsible for maintaining the confidentiality of your account and are liable for all activity under it. You may not share, assign, or transfer your account to any other person.

SECTION 2 - OUR PRODUCTS

We partner with a variety of independently owned, American-made brands. Product descriptions, pricing, availability, and imagery are provided by each vendor. While we strive for accuracy, we do not guarantee that all content is error-free, and product appearance may differ from screen representations.

SECTION 3 - ORDERS

When you place an order, it is an offer to purchase products directly from the vendor(s) fulfilling the order. Homeland Harvest reserves the right to accept or reject any order. Acceptance occurs only once the vendor confirms fulfillment. Homeland Harvest may not be able to modify or cancel an order once submitted. For returns and exchanges, refer to our Return Policy.

SECTION 4 - PRICES AND BILLING

All prices are in U.S. dollars unless stated otherwise and may change without notice. Prices do not include taxes, shipping, or handling unless stated. You are responsible for ensuring that your payment and billing information is accurate. By submitting your payment details, you authorize us and/or vendors to charge the applicable amount.

SECTION 5 - SHIPPING AND DELIVERY

Each vendor is responsible for fulfilling and shipping their own orders. Delivery times are estimates only. Risk of loss transfers upon shipment. Homeland Harvest is not responsible for delays, damages, or shipping errors.

SECTION 6 - VENDOR RELATIONSHIP & CUSTOMER SERVICE

Homeland Harvest acts as a marketplace platform. All products are sold and shipped by independent vendors. Each vendor handles its own customer service, including questions, issues, and returns. We assist with connecting you to the correct vendor if needed.

SECTION 7 - INTELLECTUAL PROPERTY

All content, logos, trademarks, and designs on the Services are the property of Homeland Harvest, Shopify, or the respective vendors or licensors. You may use the Services only for personal, non-commercial use. Unauthorized use or reproduction is prohibited.

SECTION 8 - THIRD-PARTY TOOLS AND LINKS

The Services may offer tools or content from third parties. These are provided "as-is," and we are not responsible for your use or the accuracy of third-party content or websites. Use third-party tools and links at your own risk.

SECTION 9 - SHOPIFY RELATIONSHIP

Homeland Harvest is powered by Shopify. Shopify is not involved in your purchases or order fulfillment. All transactions occur between you and the vendors on Homeland Harvest. You release Shopify from any liability relating to purchases.

SECTION 10 - PRIVACY POLICY

All personal data is governed by our Privacy Policy and Shopify’s Privacy Policy. By using the Services, you consent to data sharing between Homeland Harvest, our vendors, Shopify, and third-party partners where necessary to fulfill services.

SECTION 11 - FEEDBACK

Any feedback, reviews, or suggestions you submit may be used by Homeland Harvest without restriction. You represent that your feedback is original, lawful, and does not infringe on others' rights. We reserve the right to remove objectionable content.

SECTION 12 - ERRORS AND INACCURACIES

We reserve the right to correct errors, inaccuracies, or omissions and to change or update information at any time without prior notice, including after an order is submitted.

SECTION 13 - PROHIBITED USES

You may not use the Services for any unlawful, harmful, or abusive purpose. This includes but is not limited to spamming, infringing intellectual property, or interfering with site functionality. We reserve the right to suspend your access at any time.

SECTION 14 - TERMINATION

We may terminate your use of the Services at any time without notice. The rights and obligations of both parties that existed prior to termination will survive.

All products and services are provided "as-is" without warranties of any kind unless explicitly stated by the vendor. We do not guarantee that the Services will be uninterrupted or error-free.

SECTION 16 - LIMITATION OF LIABILITY

To the maximum extent permitted by law, Homeland Harvest and our affiliates will not be liable for indirect, incidental, or consequential damages related to your use of the Services.

SECTION 17 - INDEMNIFICATION

You agree to indemnify and hold harmless Homeland Harvest, Shopify, and our vendors from claims arising out of your use of the Services or violation of these Terms.

SECTION 18 - SEVERABILITY

If any provision of these Terms is found unlawful or unenforceable, the remainder shall remain in full force and effect.

SECTION 19 - WAIVER & ENTIRE AGREEMENT

Failure to enforce any right does not waive that right. These Terms and all referenced policies constitute the entire agreement between you and Homeland Harvest.

SECTION 20 - ASSIGNMENT

You may not assign or transfer your rights under these Terms without our consent. We may assign our rights without notice.

SECTION 21 - GOVERNING LAW

These Terms are governed by the laws of the state in which Homeland Harvest is headquartered, without regard to conflict of law provisions.
